- In addition, lawyers should pay attention to the state ethics opinions in the jurisdiction in which they are licensed. The American Bar Association also issues ethics opinions, but these are persuasive only, as the ABA does not regulate lawyers.
- It is common for law students to feel overwhelmed by the vast range of laws comprising the “law of lawyering”. Of course, the easiest to remember are the Rules of Professional Conduct. The Model Rules, from the American Bar Association, are just that - models. They are binding on no one - and are binding in no jurisdiction. Instead, each jurisdiction adopts its own version of the Rules, which may or may not be the same as the Model Rules. (much like the UCC - each state adopts its own version of the uniform commercial code). The Rules of Professional Conduct are likely the primary set of laws you will study in your professional responsibility course. However, learning the Rules is not sufficient to understand the law and ethics of lawyering.
